Liability Waiver & Assumption of Risk

Assumption of risk

I understand that tennis is a physical, athletic activity that involves inherent risks, including but not limited to sprains, strains, falls, collisions, contact with equipment or the court, heat- or weather-related illness, and other injuries or, in rare cases, death. These risks can result from my own actions, the actions of others, the condition of the courts and facilities, or the negligence of others. I knowingly and voluntarily assume all such risks, both known and unknown, and accept personal responsibility for any injury, loss or damage I may suffer while participating.

Fitness to participate

I confirm that I am physically fit and able to participate, and that I have no medical condition that would make it unsafe for me to play. I am responsible for my own health, insurance and equipment.

Release and waiver of liability

In exchange for being allowed to participate, I, on behalf of myself and my heirs and representatives, release and agree not to sue Setpoint, its organizers, operators and volunteers (the "Released Parties") from any and all claims, demands or causes of action arising out of my participation, including claims based on the ordinary negligence of the Released Parties, to the fullest extent permitted by law. This release does not apply to gross negligence or willful misconduct, or to any liability that cannot be waived under applicable law.

Facilities

I understand that matches are played at public or third-party courts that are not owned or controlled by Setpoint, and that the Released Parties are not responsible for the condition or safety of those facilities.

Acknowledgement

I have read this Liability Waiver and Assumption of Risk, I understand it, and I agree to it freely and voluntarily. During signup, checking the acceptance box records my agreement to this waiver, together with the date and time.
